ATTENTION:

All MRI employees are required to take the "Protecting Patient Privacy" HIPAA training. Additionally, Regulations require that all researchers are trained on HIPAA regulations and measures for compliance. All persons listed on the IRB application, Co-Investigators Page, Investigator?s Agreement or 1572 of any research protocol will need to have completed the HIPAA training module for Researchers in order to secure IRB approval. Additionally, Investigators will need to assure that that all key personnel involved in the research, especially personnel with data access and patient contact, have completed the HIPAA training module for Researchers.

The Health Insurance Portability and Accountability Act

HOW, WHAT, & WHEN

 HOW Does HIPAA Impact Research?

Some Phase I studies of healthy individuals such as those done in a stand-alone research-only environment may escape the scope of HIPAA, but very little else does.

WHAT Is HIPAA and What Does It Govern?

Health Insurance Portability and Accountability Act known as HIPAA is a multifaceted piece of legislation covering the following three areas:

    1. Insurance Portability: ensures that individuals moving from one health plan to another will have continuity of coverage and will not be denied coverage under preexisting-condition clauses
    2.

    3. Fraud enforcement (accountability): significantly increases the federal government?s fraud enforcement authority in many different areas
    4.

    5. Administration simplification (an oxymoron): is the most complex part of the legislation involving privacy and security of protected health information known as PHI
